These Terms of Service govern your use of MindFlash, an offline-first Android flashcard and note-taking app with local AI study tools, reminders, export tools, and a web marketing/demo surface. By using MindFlash, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app.

1. Eligibility

MindFlash is not directed to children under 13. Local AI features are intended for users who are at least 18, or minors who have parent, guardian, school, or other authorized adult supervision and permission.

2. The Current Service

MindFlash provides local decks, cards, notes, review tools, imports, exports, local AI-assisted study generation, and optional reminders. The current Android product has no accounts, no subscriptions, no in-app purchases, no remote AI processing by default, and no community sharing.

3. Your Study Content

You are responsible for the notes, files, prompts, decks, cards, drawings, and other material you create, import, export, or ask local AI to process. You must have the rights needed to use that material and must not use MindFlash for unlawful, infringing, harmful, private, confidential, or sensitive third-party material without permission.

Ordinary local AI generation does not upload your notes, decks, cards, files, or prompts to remote AI services. If you export files, share backups, contact support, or report AI output, you choose to send that information outside the local app.

4. AI Accuracy And Use

MindFlash uses generative local AI. AI-generated content can be inaccurate, incomplete, biased, unsafe, or unsuitable for your class, exam, job, or situation. You are responsible for reviewing study materials before relying on them. MindFlash is not a substitute for professional, medical, legal, financial, academic, or safety advice.

No automated decision-making processes that produce legal or similarly significant effects are carried out on you by our local AI.

Use the in-app Report AI Output action where available if generated content is offensive, unsafe, infringing, or otherwise problematic.

5. Copyright

Do not use MindFlash with content that infringes someone else's rights. Copyright concerns may be sent to mindflash.ai.support@gmail.com with enough information for us to identify the work, the allegedly infringing material, your contact details, and your good-faith statement that the use is unauthorized.

MindFlash provides a copyright complaint process for platform and product hygiene, but does not claim formal designated-agent status or safe-harbor protection.

6. Local Data Controls

Settings includes Delete all local data and Delete local AI model controls. These controls affect app-managed local data and model files on the device. They do not delete exported backups, files you shared elsewhere, support emails, reports you intentionally submitted, app-store records, or provider logs retained under provider policies.

7. Acceptable Use

You must not use MindFlash to create malware, facilitate scams, impersonate others, infringe rights, harass people, generate or store unlawful material, bypass platform policies, reverse engineer protected systems except where legally allowed, or use the app for academic dishonesty or systemic copyright violations.

8. Availability And Changes

MindFlash may change, suspend, or discontinue features for reliability, safety, legal compliance, platform compliance, or business reasons. Local AI availability depends on device compatibility, storage, battery, thermal conditions, model availability, and runtime support.

9. Disclaimers And Limitation Of Liability

MindFlash is provided as is and as available. To the maximum extent permitted by law, MindFlash is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from use of the app, local AI output, imported content, exported files, or deleted local data.

10. Governing Law & Dispute Resolution

These Terms and your use of MindFlash are governed by the laws of the jurisdiction where you reside, without regard to conflict of law principles. Any dispute arising from these Terms will be resolved through good-faith negotiations or, if unresolved, in the competent courts of your local jurisdiction.
